Instant View: GDP growth revised up, jobless claims fall

NEW YORK (Reuters) - The U.S. economy grew faster than first reported between July and September but possible cuts in government spending and tax increases early next year could slow its momentum.

Separate data showed the number of Americans filing new claims for unemployment benefits dropped for a second week, unwinding some of the storm-related surge, which has muddled the labor market picture.

"The GDP revision was not surprising. We had stronger export performance and inventory build but it seems the inventory build was intentional since orders rose in October. The jobless claims numbers are still volatile due to the hurricane. We expect contraction in November payroll employment based on dislocations from the hurricane and then some strong recoveries in payroll growth in December and January. If you look at the GDP data, the public sector grew 3.5 and private sector grew 2.1 percent, but on year-on-year basis, the private sector grew at a 3 percent rate.

"Both sets of numbers were pretty close to estimates. With jobless claims, you are still seeing the effects from Sandy, but you should see them come down in the couple of weeks. You saw the same thing happen with Katrina when you saw claims spike up because people couldn't file the claims (in the previous weeks).

"The spike in claims could show up in the next payroll report. The Beige Book didn't paint a very rosy picture on the jobs market. The trend in hiring is still relatively low.

"With GDP, the headline is higher than the initial estimate, but the details were disappointing. We saw downward revisions in two key components, consumer spending and business investment.

"The slowdown in consumer spending from Sandy might subtract a few tenths of a percent in GDP for the fourth quarter. Also firms just don't want to expand in this environment."

"GDP is a good headline number, but when you look into the figures, you see the bulk of the rise is inventory adjustment and a sharp spike in government spending. Could astronauts use a 3-D printer to make parts from moon rocks?

ScienceDaily (Nov. 28, 2012) ? Imagine landing on the moon or Mars, putting rocks through a 3-D printer and making something useful -- like a needed wrench or replacement part.

"It sounds like science fiction, but now it's really possible," says Amit Bandyopadhyay, professor in the School of Mechanical and Materials Engineering at Washington State University.

Bandyopadhyay and a group of colleagues recently published a paper in Rapid Prototyping Journal demonstrating how to print parts using materials from the moon.

Bandyopadhyay and Susmita Bose, professor in the School of Mechanical and Materials Engineering, are well known researchers in the area of three-dimensional printing, creating bone-like materials for orthopedic implants.

In 2010, researchers from NASA initiated discussion with Bandyopadhyay, asking if their research team might be able to print 3-D objects from moon rock. Because of the tremendous expense of space travel, researchers strive to limit what space ships have to carry. Establishment of a lunar or Martian outpost would require using the materials that are on hand for construction or repairs. That's where the 3-D fabrication technology might come in.

Three-dimensional fabrication technology, also known as additive manufacturing, allows researchers to produce complex three dimensional objects directly from computer-aided design (CAD) models, printing the material layer by layer. In this case, the material is heated using a laser to high temperatures and prints out like melting candle wax to a desired shape.

To test the idea, NASA researchers provided Bandyopadhyay and Bose with 10 pounds of raw lunar regolith simulant, an imitation moon rock that is used for research purposes.

The WSU researchers were concerned about how the moon rock material, which is made of silicon, aluminum, calcium, iron and magnesium oxides, would melt, but they found it behaved similarly to silica. And, they built a few simple shapes.

The researchers are the first to demonstrate the ability to fabricate parts using the moon-like material. They sent their pieces to NASA.

"It doesn't look fantastic, but you can make something out of it," says Bandyopadhyay.

Using additive manufacturing, the material could also be tailored, the researchers say. If you want a stronger building material, for instance, you could perhaps use some moon rock with earth-based additives.

"The advantage of additive manufacturing is that you can control the composition as well as the geometry," says Bose. In the future, the researchers hope to show that the lunar material could be used to do remote repairs.

"It is an exciting science fiction story, but maybe we'll hear about it in the next few years," says Bandyopadhyay. "As long as you can have additive manufacturing set up, you may be able to scoop up and print whatever you want. It's not that far-fetched."

Rhino killings for horns rapidly rise in S. Africa

VAALKOP DAM NATURE RESERVE, South Africa (AP) ? By the time ranchers found the rhinoceros calf wandering alone in this idyllic setting of scrub brush and acacia, the nature reserve had become yet another blood-soaked crime scene in South Africa's losing battle against poachers.

Hunters killed eight rhinos at the private Finfoot Game Reserve inside the Vaalkop Dam Nature Reserve this month with single rifle shots that pierced their hearts and lungs. The poachers' objective: the rhinos' horns, cut away with knives and popped off the dead animals' snouts for buyers in Asia who pay the U.S. street value of cocaine for a material they believe cures diseases.

That insatiable demand for horns has sparked the worst recorded year of rhino poaching in South Africa in decades, with at least 588 rhinos killed so far, their carcasses rotting in private farms and national parks. Without drastic change, experts warn that soon the number of rhinos killed will outpace the number of the calves born ? putting the entire population at risk in a nation that is the last bastion for the prehistoric-looking animals.

"This is a full-on bush war we are fighting," said Marc Lappeman, who runs the Finfoot reserve with his father Miles and has begun armed vigilante patrols to protect the remaining rhinos there. "We here are willing to die for these animals."

Unchecked hunting nearly killed off all the rhinos in southern Africa at the beginning of the 1900s. Conservationists in the 1960s airlifted rhinos to different parts of South Africa to spread them out. That helped the population grow to the point that South Africa is now home to some 20,000 rhinos ? 90 percent of all rhinos in Africa.

From the 1990s to 2007, rhino poachings in South Africa averaged about 15 a year, according to a recent report by the wildlife trade monitoring network TRAFFIC. In 2008, however, poachers killed 83 rhinos and by 2009, the number hit 122, the report says.

The killings grew exponentially after that: 333 in 2010, 448 in 2011 and as of Tuesday, at least 588 rhino killed this year alone, according to South Africa's Department of Environmental Affairs.

"That the year-on-year rhino poaching losses have continued to grow in the face of heightened awareness, constant media attention and concerted law enforcement effort is testament to just how pervasive and gripping the rhino crisis in South Africa has become," TRAFFIC wrote in its August report. "If poaching continues to increase annually as it has done since 2007, then eventually deaths will exceed births and rhino numbers in South Africa will start to fall."

Most of the killings, according to government statistics, occur in South Africa's massive Kruger National Park, covering 19,400 square kilometers (7,500 square miles) in the country's northeast abutting its borders with Mozambique and Zimbabwe. There, the impoverished slip across the park's borders, largely from Mozambique, to kill and dehorn rhino, earning the equivalent of months' wages in a single night of hunting. South Africa has deployed soldiers in the park with dogs to sniff out poachers, but their small force can't sufficiently cover a park that's roughly the same size as New Jersey.

The horns are sold by criminal gangs and smuggled into Asia. While poachers have been shot dead and hundreds of suspects arrested this year, the rhino killings continue unstopped largely because the trade is transnational and worth millions of dollars, said Julian Rademeyer, a journalist in South Africa who wrote "Killing for Profit," a book on rhino poaching that came out this month.

"The problem with law enforcement strategies is they end where our border ends," Rademeyer said.

And law enforcement can't always be trusted in South Africa, where corruption eats away at the nation. There have been several cases of rangers assigned to guard parks being arrested for aiding poachers.

With both South Africa and Swaziland allowing rhino to be hunted legally, criminal gangs have obtained hunting licenses under false pretenses. Gangs have hired prostitutes and the poor from Asia and Eastern Europe to pose as big game hunters with licenses to kill a single rhino apiece, Rademeyer said. Their "trophies" end up shipped back to Asia, where the horns are removed and sold.

Rhino horn is made of keratin, a tough protein found in human fingernails. Doctors have repeatedly said the material has no medical value. In Asia, however, demand for rhino horn has jumped dramatically. Experts blame it partly on a widespread rumor in Vietnam that rhino horn cures cancer, though some elite Vietnamese grind up horn and take it as a hangover cure or as a fever reducer.

The ever-increasing demand saw Vietnamese poachers kill the last of Vietnam's rare Javan rhinoceros last year for its horn. The World Wildlife Fund ranked Vietnam as the worst country for wildlife crime in Asia and Africa in July. The country is seen as having lax laws on importing horns. Diplomats at the Vietnamese Embassy in South Africa's capital Pretoria have also been linked to trafficking. Earlier this month, a South African court sentenced a Thai national to 40 years in prison for selling rhino horns.

With high-level officials involved and a strong demand, Rademeyer said poaching "will probably get a lot worse before it gets any better."

Rhino poachers have gone beyond Kruger and are targeting private farms and reserves. Poachers likely watched the Finfoot Game Reserve, which breeds rhino for game viewing, for days, Lappeman said. Workers caught a man in ragged clothes lurking around the park with more than 1,000 rand ($115) in crisp hundred rand bills and a new mobile phone in his pocket around the time of the killings, Lappeman said.

The poachers fired on the rhino far from the game lodge, probably moving methodically closer as no one came to investigate the shots, he said. Lappeman said he and his father only found the dead rhinos the day after seeing the lost calf.

One wounded mother rhino walked all the way to the property's edge, finally dying on a dirt road to be found first thing that morning.

"She had physically come to the road to die, to say, 'I'm dying, come fetch my calf,'" Lappeman said.

Help on Healing from HeartbreakThere?s a reason why ?heartbreak? is synonymous with ?breakup.? Breakups are painful. It can feel like the pain resides in our heads, our hearts and in our bones. Sometimes it?s a faint ache, like a sore muscle. Other times, it?s a full-on throbbing, a raw wound.

Post-breakup, people often ?feel sad, lost, empty, alone, and angry,? said Meredith Hansen, Psy.D, a clinical psychologist and relationship expert. They might withdraw from friends and family and have a hard time doing their work, and their self-esteem might suffer, she said. According to Hansen, they might also show other signs of depression, such as loss of interest in activities, loss of appetite, development of sleeping problems or feelings of hopelessness.

People suffering from heartbreak might turn to self-destructive behaviors with grave effects. ?Substance abuse, multiple sexual partners, and avoidance of vulnerable emotions can lead to serious health issues, long-term health problems, and potential mental health issues,? Hansen said.

Time helps to heal heartbreak, but there are many things you can do now to feel better, she said. Below, Hansen shared six suggestions for healing healthfully.

1. Seek support from loved ones.

?Reach out to people in your life who love you, care about you, and want the best for you,? Hansen said. ?Talk to them about your feelings and how the loss has affected you.?

2. Seek support from a therapist.

Right after your breakup, you might feel more comfortable talking to your loved ones, Hansen said. However, after a while, you might avoid reaching out because you worry your loved ones expect you to stop grieving. That?s when talking to a therapist can help. ?Having an outlet to express the pain, discomfort, fears, and sadness, such as a therapist?s office, can reduce the sense of guilt and shame a person may feel for not ?getting over it yet.??

Also seek help if it?s been a month or two and you still don?t feel better ? or you feel worse and have more intense depressive ruminations, Hansen said. ?A therapist will be able to assist with the depression, helping you feel better and regain your self-esteem and hope for the future.?

3. Be realistic about bouncing back.

Expecting yourself to bounce back after heartbreak is unrealistic. (And this expectation, when inevitably unmet, can just make you feel worse.) ?You have lost an important person in your life and it is to be expected that you will not feel like your normal self or be able to accomplish normal chores, activities [and] duties,? Hansen said.

4. Appreciate your steps ? however small. ?

Acknowledge the steps you have taken to heal, Hansen said. This could include anything from going to work to opening the blinds to having lunch with a friend to brushing your teeth, she said. ?You have to remember to honor where you are and acknowledge yourself for what you are doing.?

5. Get active.

When you?re feeling depressed, it?s especially important to move and trigger those feel-good endorphins. But this doesn?t have to be a long run or a tough workout. ?Even if you can only walk down to the corner store, around the block, or just to the mailbox, that is still something,? Hansen said. Do what you can, and try to incorporate more activity every day or week, she said.

6. Avoid unhealthy behaviors.

Avoid diving into a new relationship or engaging in casual sex, Hansen said. ?Casual sexual relationships immediately after a breakup can cause a person to become overly attached to someone that they wouldn?t otherwise be interested in.?

Also, avoid withdrawing from others, clinging to your ex or the hope that you?ll get back together and continually beating yourself up, she said.

Instead, give yourself time to heal, savor your alone time and reconnect with both yourself and your loved ones, she said. (Here are some ideas for savoring solitude.)

?Only you will know when you are ready to move on, but remember that it will get better, you will heal, you will meet someone new, and you will enjoy life and love again,? Hansen said.

'Second skin' could protect soldiers from chemical threats

Advances in nanotech have allowed research into materials that actively detect and shut out harmful molecules, or even shed layers like real skin. It?could be a lifesaver for soldiers and emergency workers.

A soldier in the field has lots of protection: A helmet, flak jacket, armored panels and so on. But when it comes to chemical and biological warfare, that equipment is virtually useless. Gases and bacteria can penetrate or simply cling to soldier's garments and gear, wreaking havoc later despite being highly diffuse.

The risk can't be mitigated entirely, but polymer scientists at the University of Massachusetts at Amherst and Lawrence Livermore National Laboratory are working on a "second skin" made of?smart materials that would be a far more effective and sophisticated defense than we have now.

They call the fabric they're working on a "hybrid functional material," and it's made of a combination of carbon nanotubes and specially?designed nanoparticles. It's designed not just to block out unwanted agents, like poisonous gas molecules and spores, but to be normally breathable as well in less dangerous situations.

At a molecular level, the nanotubes are aligned vertically and arranged to form pores just a few nanometers wide. While ordinary air can pass through these tiny "nanopores," larger molecules and organisms like viruses simply don't fit.

There are smaller threats, however: Nerve agents and mustard gas would go right through even such tiny gaps. The nanomaterial?membrane?would be coated with "responsive functional groups," special molecules designed to respond to the presence of such deadly toxins. Activated molecules would trigger the nanopores to shut completely.

Lastly, in the case of agents that tend to stick around instead of diffusing, such as anthrax, the material will be designed to slough them?off, mimicking human skin. That way a garment exposed to infection wouldn't bring it back to, or out of, a hospital or base.

A Letter from Dracut School Committeeman Matt Sheehan ...

I support Greater Lowell Tech.

Twelve years ago I had the privilege of attending the Greater Lowell Technical High School. During my four years there, I studied culinary arts under the direction of great teachers including Paul Morin, Arnold Price, Sandra Day, and the late Peter Coffin. The education that I received at Greater Lowell prepared me well for the transition to college where I earned my Associates Degree in Science.

The need for well-trained service and technical professionals is ever expanding. From traditional vocational service fields such as culinary arts, plumbing, and carpentry, to technical arts trades such as machine engineering, electronics, and office technology, to human service fields such as early childhood education, medical assisting, and hotel management Greater Lowell Technical High School provides education and training for these fields that are always desirable.

Over the years, Dracut has benefited from the training that Greater Lowell provides our children. For example:

? Electrical- Rewiring and installation of air conditioning units at the senior center

? Auto Tech-Painting of several police cruisers as well as a fire truck

? Carpentry- Students built a screen house and two storage sheds for the Dracut Housing Authority

? Painting- Painted town Hall

?Greater Lowell has given back $385,707.00 over the past ten years towards Transportation costs.

Greater Lowell?s facility is in need of improvements to support the efficient operation of the physical plant and to maintain the educational programming provided by the school. I am writing this letter to support the renovation project at Greater Lowell Tech. I write this letter of support as a proud alumnus, a Dracut Taxpayer, and an honored elected official.

The Dracut Public Schools has an outstanding and wide-ranging educational program.. There are, however, certain programming it cannot offer such as those listed above and others. The regionalization of vocational programming is an efficient way of supporting students who wish to pursue areas of study outside of the existing offerings of our community high schools. This is just one of many reasons that I support the renovation project for Greater Lowell Tech. When it comes to the education of our young adults of Dracut, we need to work together to provide the best learning environment we can.

The total price for this project is $65,310,211.00. The MSBA reimbursement rate is 76.84% or $50,088,316.00, leaving a balance of $15,030,825.00 of which Dracut?s cost is $3,124,909.00. Projects like these are proof of what our tax dollars can do in the state. The community?s financial obligation to its students who attend Greater Lowell is most efficiently met through support for the renovation project.

I ask that on December 11, 2012 the voter?s of Dracut carefully consider the numerous advantages to our students and support the renovation project for Greater Lowell Tech.

Gene linked to respiratory distress in babies

ScienceDaily (Nov. 27, 2012) ? Some infants are more susceptible to potentially life-threatening breathing problems after birth, and rare, inherited DNA differences may explain why, according to research at Washington University School of Medicine in St. Louis.

The study is the first to identify a single gene -- ABCA3 -- that is associated with a significant number of cases of respiratory distress syndrome (RDS) in babies born at or near full term. RDS is the most common respiratory problem in newborns and the most common lung-related cause of death and disease among U.S. infants less than a year old.

Their findings will be published in the December 2012 issue of Pediatrics and are available online.

The research may lead to new diagnostic and therapeutic strategies for prevention and treatment to improve respiratory outcomes for babies.

"We found that mutations in ABCA3 account for about 10 percent of respiratory disease in babies born near their due dates," said Jennifer A. Wambach, MD, assistant professor of pediatrics and the study's lead author. "These are babies who we typically think should have mature lungs and breathe normally. While we have known for a while that RDS is a heritable disease, this is the first gene to account for a significant proportion of disease among infants that are full-term or nearly full-term."

RDS occurs when an infant's lungs don't produce enough surfactant, a liquid that coats the inside of the lungs and helps keep them open so the baby can breathe. If there isn't enough surfactant, an infant has to work hard to breathe and may suffer from a lack of oxygen. Premature infants are at especially high risk of RDS, as surfactant production increases as babies near term. However, 2 percent to 3 percent of term and near-term babies also develop RDS.

The researchers' findings suggest a range of possibilities, Wambach said. These include using the genetic knowledge to plan affected infants' births near hospitals with neonatal intensive-care units and developing medical therapies to target the abnormal protein resulting from these mutations.

Wambach said the researchers hope to identify additional genes that cause neonatal RDS and better identify babies at risk.

"But right now we're studying how these mutations function in the laboratory," Wambach said. "Statistical associations help guide us, but we also need to understand the biology of these mutations."

The research team -- including Aaron Hamvas, MD, and F. Sessions Cole, MD -- evaluated five genes known to be important for normal breathing immediately after birth. Hamvas is the James Keating Professor of Pediatrics and medical director of the newborn intensive care unit at St. Louis Children's Hospital. Cole is the Park J. White, MD, Professor of Pediatrics.

The team looked at five genes involved in the metabolism of lung surfactant by taking DNA samples from more than 500 infants of African and European descent, with and without respiratory distress, who were carried to term or near term. They evaluated the same genes in an additional 48 babies with especially severe respiratory distress to see if their findings applied to that group, and in a third group of 1,066 Missouri babies, to determine the frequency of the mutations in a general population.

In comparing babies with and without respiratory distress, they found that babies of European descent with respiratory distress were more likely to have a single mutation in ABCA3, one of the five genes tested, than the infants with no breathing problems. Babies of African descent with respiratory distress also were more likely to have single ABCA3 mutations, but this difference did not reach statistical significance.

More than one-quarter of the babies with especially severe respiratory distress had a single mutation in ABCA3. Infants who inherit two defective copies of the ABCA3 gene usually require lung transplantation for survival. However, this is the first study to show that a single mutation in ABCA3 predisposes infants to respiratory distress that can usually be treated with neonatal intensive care.

The researchers also found that 1.5 percent to 3.6 percent of babies born in Missouri carry a single ABCA3 mutation, leading the researchers to estimate that about 10 percent of RDS cases among term and near-term infants may be attributable to mutations in ABCA3.

"We picked five candidate genes and thought we would find rare mutations in all of the genes," Wambach said. "However, we found very few mutations in the other genes, and they were not associated with RDS. Our findings were really isolated to this one gene, ABCA3."

(AP) ? Four gay men accused a New Jersey organization of fraud Tuesday for selling "conversion therapy" with false promises to make them straight.

They said during a Manhattan news conference that they were subjected to humiliations that included stripping naked and taking a baseball bat to effigies of their mothers.

The four attended sessions at the Jersey City, N.J.-based Jews Offering New Alternatives to Healing, or JONAH. The nonprofit advertises in Jewish publications and claims to rid men of same-sex attractions.

Three of the men are Jewish ? Chaim Levin, Benjamin Unger, and Sheldon Bruck. The fourth, Michael Ferguson, is a Mormon now living in Salt Lake City who was a college student in New York when he signed up for the services.

The men say in a lawsuit that the methods do not work and should not be marketed under New Jersey's consumer protection laws. They say the suit was filed Tuesday in New Jersey, but officials there could not confirm receiving it.

The men say in the suit that JONAH's practices included telling them "that gay sexual orientation is a mental disorder and gay people must change to straight in order to lead satisfying and happy lives" and "that when conversion therapy does not produce the promised results, the clients themselves are to blame for not sufficiently investing in and surrendering to Defendants' services."

JONAH did not return calls requesting comment.

The group's mission statement on its website says JONAH is "dedicated to educating the world-wide Jewish community about the social, cultural and emotional factors which lead to same-sex attractions."

Its claim that being gay is a mental disorder that can be reversed has been rejected by the American Psychiatric Association.

Speaking for the men at Tuesday's news conference were attorneys from the Southern Poverty Law Center, a Montgomery, Ala.-based civil rights organization.

"JONAH profits off of shameful and dangerous attempts to fix something that isn't broken," said Christine P. Sun, the center's deputy legal director. "Despite the consensus of mainstream professional organizations that conversion therapy doesn't work, this racket continues to scam vulnerable gay men and lesbians out of thousands of dollars and inflicts significant harm on them."

California has taken action against providers of conversion therapy.

Last month, California Gov. Jerry Brown signed a bill that prohibits licensed mental health professionals from using so-called reparative or conversion therapies with clients under age 18. Brown called the therapies "quackery" that "have no basis in science or medicine."

Two New Jersey lawmakers are drafting similar legislation.

Oldest wooden church in Canada designated a national historic site

TADOUSSAC, Qc - Sainte-Croix-de-Tadoussac Mission Church, built between 1747 and 1750 at the confluence of the Saguenay and St. Lawrence rivers and considered Canada's oldest wooden church, has been designated a national historic site.

"It is the only remaining original place of worship that tells the stories of the missionary activities of the Jesuit fathers in the remote regions of New France and of the conversion of the Innu First Nation people (the Montagnais) to Christianity," said a release from Parks Canada, which operates many of the country's national historic sites.

The small chapel, about 200 kilometres northeast of Quebec City, was constructed at a time when Tadoussac was an active fur-trading centre. Its architectural features, including a bell tower and front-gable roof, make it "an outstanding example of mission churches erected in New France."

The original siding of vertical planks was replaced in 1866-1867 with horizontal clapboard siding.

The church is among recent Quebec additions to the roster of over 1,500 places, persons and events that have been officially commemorated for their national historic significance. The others announced by Parks Canada are artist Marc-Aurele Fortin, museum builder Frederick Cleveland Morgan, the former Lamaque mine and Bourlamaque mining village in Abitibi, the Inuit co-operative movement and the Arvida historic district.

Lions defensive tackle Ndamukong Suh still hasn?t spoken about his, um, interaction with Texans quarterback Matt Schaub on Thanksgiving.? However, Suh has no qualms when it comes to talking about his ambitions.

?I do see multiple Super Bowl rings in my future, especially with the team we have now,? Suh says in an upcoming issue of ESPN The Magazine, via Dave Birkett of the Detroit Free Press.? ?We?re a team where if we don?t make mistakes, we are insanely dangerous.?

Some would say that some of the players have been dangerous off the field, insanely or otherwise.

Suh was dangerous, sort of, last Thanksgiving, when he stomped on the arm of Packers guard Evan Dietrich-Smith.? But Suh, who presumably spoke before Thursday?s game, says he has matured.

?I definitely understand how to channel my aggression in a productive way,? uh said. ?There are many reasons.? One is I went through that situation last Thanksgiving.? But also, any man, any child grows up. You learn from your mistakes or you go backward.? I?m the kind of person who wants to move forward. My fire is still there.? And when I get a full opportunity to unleash my fire, it?s like the hit I put on [Chicago Bears quarterback Jay] Cutler.? By no means am I trying to hurt him, but I am going 100 [mph] and trying to get him as quickly and as hard down to the ground as possible.? That?s the way I show my dominance, and I am going to continue to do that.? If that situation happens again with Cutler, I?m gonna hit him the same way, if not harder.?

While Suh won?t be suspended for his successful attempt to bring Schaub to the ground in a non-traditional way, Suh likely will be fined.

Whether he?ll will multiple Super Bowls is slightly less clear.

Obama may get chance to end Benghazi PR disaster

WASHINGTON (AP) ? The White House could finally have its chance to close the books on its Benghazi public relations disaster, as key Republicans signal they might not stand in the way of U.N. Ambassador Susan Rice to become the next secretary of state.

"I think she deserves the ability and the opportunity to explain herself and her position," Sen. John McCain, R-Ariz., told "Fox News Sunday." ''But she's not the problem. The problem is the president of the United States," who, McCain said, misled the public on terrorist involvement.

Rice is widely seen as President Barack Obama's top pick to replace Secretary of State Hillary Rodham Clinton as the nation's top diplomat. But Rice's reputation took a serious hit this fall when she relied on unclassified talking points provided by the intelligence community that portrayed the attack in Benghazi, Libya, as a spontaneous assault by a mob angered by an anti-Muslim video posted on YouTube.

Intelligence officials quickly amended their assessment to conclude the attack hadn't been related to other film protests across the Middle East. But that revised narrative was slow to reach the public, prompting Republicans to allege a White House cover-up ahead of the Nov. 6 election.

0The attack killed Ambassador Chris Stevens, a State Department computer specialist and two former Navy SEALs who were working as contract security guards.

McCain's remarks were in contrast to his previous stance that Rice wasn't qualified to replace Clinton, who is expected to step down soon, and that he would do "whatever is necessary" to block Rice's possible nomination.

Sen. Lindsey Graham, McCain's close friend and colleague on the Senate Armed Services Committee, told ABC's "This Week" he still suspects the White House intentionally glossed over obvious terrorist links in the attack to keep voters from questioning Obama's handling of national security.

But instead of repeating his prior assertion that he was "dead set" against a Rice promotion, Graham suggested he looked forward to hearing her out. If Rice were nominated, "there will be a lot of questions asked of her about this event and others," said Graham, R-S.C.

The subtle shift in GOP tenor on Rice could be the result of internal grumblings on how far to take party opposition. Democrats picked up extra Senate seats in the election to maintain their narrow majority, making it that much harder for the remaining 45 Republicans to block the president's nominees.

One senior GOP Senate aide said Sunday that Republicans hadn't united against Rice and were not convinced she was worth going after.

"There's a definite sense within the caucus that you have to be conservative about where you put your firepower," said the aide, who spoke on condition of anonymity because the official was not authorized to speak publicly on internal GOP deliberations. "The question is whether the caucus is prepared to filibuster her, and I'm not sure we were."

Court orders new look at health care challenge

(AP) ? The Supreme Court has revived a Christian college's challenge to President Barack Obama's healthcare overhaul, with the acquiescence of the Obama administration.

The court on Monday ordered the federal appeals court in Richmond, Va., to consider the claim by Liberty University in Lynchburg, Va., that Obama's health care law violates the school's religious freedoms.

A federal district judge rejected Liberty's claims, and the 4th U.S. Circuit Court of Appeals ruled that the lawsuit was premature and never dealt with the substance of the school's arguments. The Supreme Court upheld the health care law in June.

The justices used lawsuits filed by 26 states and the National Federation of Independent Business to uphold the health care law by a 5-4 vote, then rejected all other pending appeals, including Liberty's.

The school made a new filing with the court over the summer to argue that its claims should be fully evaluated in light of the high court decision. The administration said it did not oppose Liberty's request.

Liberty is challenging both the requirement that most individuals obtain health insurance or pay a penalty, and a separate provision requiring many employers to offer health insurance to their workers.

The appeals court could ask the government and the college for new legal briefs to assess the effect of the Supreme Court ruling on Liberty's claims before rendering a decision.

Liberty's case joins dozens of other pending lawsuits over health reform, many involving the requirement that employer insurance plans cover contraception, which are working their way through the federal court system.

The case is Liberty University v. Geithner, 11-438.
